A trademark is more than a name — it is a doorway to your business. Just registering a trademark is not enough. In many jurisdictions, a trademark must be actively used to uphold it. If a company stops using a mark, others can try to claim it for themselves.
Ferrari's famous brand Testarossa shows how even iconic brands can run into this problem.
The Testarossa is one of Ferrari's best-known cars, strongly associated with 1980s design, performance and ... Miami Vice. Yet Ferrari stopped producing them in the nineties. That opened the door for German entrepreneur Kurt Hesse to challenge Ferrari's rights. His company wanted to use Testarossa for bicycles, e-bikes and e-scooters. Ferrari objected, but the legal question was uncomfortable: had Ferrari still been using the trademark sufficiently for the relevant goods and services?
The case shows a simple but important rule:
A trademark is not a trophy you keep in a drawer. It has to be used.
After a certain period of time or in a legal dispute, proof of use needs to be provided. That proof can include labeled products, packaging, website sales pages, advertisements or other evidence showing that the mark is still in active use.
Ferrari initially ran into difficulties because the Testarossa car had been out of production for such a long time. On appeal, Ferrari managed to keep their rights — but only by the skin of their teeth: they pointed to a factory-certified restoration program that refurbished classic Testarossa models. Just enough to show that they still used the mark. Truth be told: they just got lucky.
The Testarossa name carries enormous brand value. It immediately evokes Ferrari, speed, design, exclusivity and — for some of us — nostalgia.
Allowing unrelated products such as bicycles or e-bikes to use the same name could weaken that association. Even if consumers do not directly confuse the products, the brand may lose its powerful aura over time.
Ferrari's case is entertaining because it is such an iconic brand. But for brand owners, the lesson is serious.
Register your trademarks. Use them consistently. Along the way, gather and securely store proper proof of use.
Because if you cannot show that you are using your trademark, someone else may eventually try to put your legendary brand name on a bicycle — or worse.
